A Simple Constitution for Iran

99.999% of Iran’s problems come from the sick and infected 1979 Khomeini constitution, that Khamenei illegally replaced with his own even more diseased one in 1989.

 

The current constitution grants him all of the nastiest power and better than that, unquestionable, unearned, and unauthorized influence over every single aspect of Iranian life. For life.

 

He is not accountable to any body or group or committee or congress that represents free Iranians.

 

Or Iranians are not free.

 

He can do as he wants, including the most egregious act of bringing the science fiction charge of imagining insults, including “thought crime" against any opponent. Who are currently young and old journalists, or his favorite delicacy, Iranian bloggers. Deliciously served cold, over a nice bed of moist electrodes, with a side of fresh hot rape. Mmmm! Mmmm! Mmmm!

 

All of this tyrannical brutality comes directly from the constitution, that Khamenei wrote, specifically to rule Iran like all of Iran’s absolute rulers and kings have ruled Iran before him.

 

However, this is not what a constitution is supposed to do. Of course to the average despot in the making, it certainly seems like a good way at the time. Especially if you can lock it in with religious authority, and a nice militia-intimidated referendum.

 

Or so Morsi thought.

 

A constitution though, is a broad basis document, that drives all the lesser smaller, more detailed laws of a country. It does not have to do much, other than outline the basics. 

 

So, if I was to say, pull a Khamenei on you for a moment, and design one for Iran, it would go a little something like this:

 

I could skip a Bill of Rights, because the following things would be Free: Education, Choice, Religion, Speech, and of course Thought. :)

 

2-3 branches of elected government: President, Majles. A Supreme Court is optional, because this is a simple constitution, and there would not be much to interpret.

 

The President would "manage" the business of the country, as the country's business manager, for a 6 year term. She would submit budgets and expenditures, and plans of how to spend the oil revenues, and can choose her nominees for the various ministries, but the Majles would have to approve these budgets, plans, and appointments by a simple majority vote of at least 51%. 

 

The Majles would make the laws that the people want made for the same 6 year term as the President. Majles can only create laws that do not change the Constitution, and do not change voting districts, and can impeach a bad President if needed, with a simple but overwhelming majority vote of 80%. (not 51%)

 

Unlimited parties, including socialists and communists. Elections are online, and are held the day before NoRooz. Voting districts are drawn up by the people through civic participation.

 

No taxes, just a national Sales tax. Religions that collect money must pay the Sales tax. Obviously.

 

No Military. So no wars. So no Death.

 

No Death penalty. So no government executed Death.

 

And finally, no religious leader will ever be allowed to run for any office or hold any official position. Including dog catcher.

 

I think that will work out just fine. Or feel free to add your own suggestions. Just try to keep it simple though, so we don't have to have a Supreme Court to interpret it.

I mostly agree, what you missed is that even this stupid constitution is not practiced. I mean they do not obey their own stupid constitution. So even if we had the best constitution when it is not practiced it is as good as not having one.
On serious note I would take US constitution and eliminate the words god or creator and translate it into Persian and make it our new constitution.
There should not be any public institutionalized religion what so ever.

That is silly. The failure has been in the application not the laws. There was nothing wrong with the 1906 Constitution.

4 of the Top 5 most democratic countries are mostly constitutional monarchies. That is a good goal to have Like Norway, Sweden, Denmark, New Zealand etc. http://www.indiatimes.com/lifestyle/work-and-life/5-most-democratic-nations-75171.html#list_start however Iran's situation is complex, the people are now 3rd world and living in a tyrannical fashion with extreme corruption in every organization nationally Iran is nowhere near having the capability to enjoy democratic government with out being dominated from outside as it is today with the foreign loved mullahs.

Iran is too important especially as a result of its resources. etc it requires a focus on Industrialization, education and developing a middle class as the late shahs team were doing with a focus on peace, progress and human rights. Iran's importance geo-politically as well as the state its people are in makes a simple solution unworkable in practice. You are just as likely to enjoy peace, progress and human rights in Iran with Democratic Government today as the democracies of Nigeria. Iran will out of necessity produce a Reza Shah to handle all the various gangs that are criminally ruining the country of course there may still be a process necessary where idealists envision a straight move to democracy as you suggest and after in practice giving Iranians even greater suffering and exploitation not help before a Reza Shah and a team of elites take control. Russia is enjoying greater Peace, Progress and Human rights with Putin than if they were to allow themselves to be dominated by the USA as they were with Yeltsin, Iranians may need to go through a similar period of extreme suffering, in order to truly beat the living S&^% out of their impractical dreams of democracy out of thin air, before it is right and good for Iran to have a Reza Shah. One Main lesson of 1979 was that Iranians were a people following false pride (honestly thinking they could do a better job than the late shahs team) as well as a nation holding on to cruel hopes (that they could achieve a goal with no basis in reality to have the hope). The idea of coming up with a democratic constitution is an enacting is to take action without even having learned the lessons of past mistakes on a national level. I'm hoping you are exploring ideas not actually thinking a simple constitution is the answer in light of the difficulties Iran faces from within and outside.

BTW No military does not mean no wars. Of Course Military industrial complexes need to manufacture wars to keep themselves alive, but there is a more sensible approach and unfortunately systems of government that are controlled by money are the greatest danger to peoples liberties because in practice the interests of weapons makers and oil companies are prioritized by the biggest corporations which produce nothing and are money management companies.

Voy, Voy, Voy, Chi Shod???? A King is not an Absolute Ruler. Which is why Socrates and Plato defined Kings differently than Dictators. A King abides by laws like Mohammed Reza Pahlavi did and because the ones that inherit power are highly unlikely to every be able to achieve absolute power as their claim to power is not through the power and strength of their alliances as it is for elected Presidents. Until 99.99 % of Iranians can grasp this simple point enough to not be influenced by the corporate thought control media of the day Iranians are more a danger to themselves exactly as the thought control media wishes.

You are right to belittle Republics like the USA and their Supreme Courts which are selected by Politicians to protect their criminal, tyrannical, dictatorial and clearly unlawful actions and safe guard the interests of corporations and those who are in practice ruling the country. It looks like what you are aiming to create is a country where the Money does not Rule and the Institutions are focused on their correct respective priorities which they are meant to serve? Ey, Voy You are revealing yourself to be a closet Monarchist, when you allow yourself to think of the culture of society and it's institutions first and not the systems of government.

A culture which performed this way during most of Irans History and Since Europe hypocritically Loves Religious Extremism in power for us and not wants to enjoy separation of church and state only for themselves. It becomes obvious why our National Culture as developed by Iranian Scientists, Poets, Philosophers, artists and others which is embodied by the system of Shah-han-shahi would be under attack from the corporate thought control media. What the Iranian Monarchy achieves for Iran literally opposes their wishes for our country of Iran.

In Iran's 2500 year Long History of Shah-han-shahi Iranians have produced less Autocrats who act with out speaking to anyone and Dictators who use absolute powers not given to them than the USA which in only the last 200 years has given the world so many Tyrants, all publicly elected. Iranians Ironically when you see the country today, have Given the world the most sane leadership over the Millenia as a result of the Shah-han-shahi system.

There are several constitutions that already address your concerns, for example, Iran Secular (see in Facebook). Furthermore, there is a push to unite these groups under one umbrella, e.g., a few blogs down at (پیشنهادی به کنگره سکولار دموکرات: هرم همبستگی‌!).


I would like to address two of the points you brought up above:
Iran is in a tough neighborhood, and having a defensive force is not a bad idea, cf. Saddam's invasion of Iran.
Also, the vote of majority, although sound good on paper, however, these votes need to push against a backdrop of individual rights (secular democracy). For example, the lynch mobs of the last century here in the US were based on a rule of majority of whites who did not like what was going on and decided to hang or burn blacks.

It's risky, I'll grant you. But Costa Rica does it just fine. Think about it, if we had no army, we would have very few casualties. Sure, we'd lose, but then thats theoretically what the UN World court is for.

Keep in mind, Saddam was also turned back very quickly and made to repay damages, to Kuwait by an international force. I'll argue that the same force would have turned Saddam back from a similar attack on a defenseless democratic and free Iran.
