WASHINGTON — President-elect Obama's advisers are quietly crafting a proposal to ship dozens, if not hundreds, of imprisoned terrorism suspects to the United States to face criminal trials, a plan that would make good on his promise to close the Guantanamo Bay prison but could require creation of a controversial new system of justice...
>>>
I can't believe they are calling it controversial just because it's not "bush's way"! If they're being held as criminals for over 5 years, why not have criminal trials? Any lawyers in the house to explain the difference to me?
The move would be a sharp deviation from the Bush administration, which established military tribunals to prosecute detainees at the Navy base in Cuba and strongly opposes bringing prisoners to the United States. Obama's Republican challenger, John McCain, had also pledged to close Guantanamo. But McCain opposed criminal trials, saying the Bush administration's tribunals should continue on U.S. soil.

fine then
by American Wife on Tue Nov 11, 2008 10:06 AM PSTYou're being realistic. Like I said, let us enjoy our moment. It IS a big moment too. Every great movement began with one step. Whether the first step on the moon... Rosa Park's first step towards equality...
No one here is expecting miracles. We're not placing Obama on a pedestal. We've never called him the Messiah. We're intelligent people who have particular causes and concerns. We voted for Obama because we felt he could best address those issues. It was a moral victory for the country as well. He's been more pro-active in 48 hours than Bush was in 4 years.
Ebi is right though... this needs to be done RIGHT or not at all.
It's Realistic Not Pessimistic
by Kaveh Nouraee on Tue Nov 11, 2008 09:50 AM PSTThere's a tremendous difference between being positive and pinning all of your hopes and dreams on the man.
What's disturbing is that Obama hasn't done a single thing as president yet, and has honestly done very little in the U.S. Senate outside of campaigning for the presidency, yet he is being placed on this pedestal built on this mountain of high expectations.
Oh come on!
by American Wife on Tue Nov 11, 2008 09:36 AM PSTIt's hardly naivete Kaveh! It's called positivity! After 8 years of total inaction by Bush on anything constructive... it's a breath of fresh air to see Obama getting proactive. We all know that he's not perfect. We all know he's not going to get everything done in one term. We know he's going to falter and screw up a time or two. But why in the world are you being SO pessimistic?
Chill out and let us enjoy the moment...:-)
The God Father of International Terrorism would be happy!
by Anonymous500 (not verified) on Tue Nov 11, 2008 09:01 AM PSTIt takes one homicidal-bombing by one criminal-to his-core terrorists of the Al-Qeda to bring these wishy washy "chapools" of San Franciscoies back to the world of reality as to what the War Against International Terrorism means; more than 50 of those who have been released from GITMO in the past several years, have already been either rearrested for the crime of terrorism, or have been sent to JAHANAM, by our GIs in different war theatres.
Mr. Obama would do himself and the sane and civilized world and our country much favor before attempting to close GITMO; he is a highly intelligent man and he'd better take this issue quite seriously as the closing of GITMO would only help Al-Qaeda and its new boss, the IRI in Iran.
It is good news,but....
by ebi amirhosseini on Mon Nov 10, 2008 08:25 PM PSTit should be done properly & in the best interest of innocent poeple not the guilty ones.
too bad

The Naivete is So Deep
by Kaveh Nouraee on Mon Nov 10, 2008 05:22 PM PSTIt is utterly amazing that no one has drowned.
AW at least acknowledges the fact that it's a mess. But to think that this is just the beginning of one right move after another is telling me that some of you are living in some idealistic FantasyLand, and that Barack Obama is some messianic Walt Disney who is going to wash all of the troubles in the world away.
you've got it Abarmard

Now we can all relax. he will do the right thing

by Kaveh Nouraee on Mon Nov 10, 2008 04:29 PM PSTThese yo-yos locked up in Cuba are enemy combatants who do the voodoo they do on behalf of Al-Qaeda.
Sammy bin Laden hit the U.S. once. They can easily hit it again.
not sure what you mean by
by American Wife on Mon Nov 10, 2008 04:00 PM PSTbringing them onto US soil might invite retaliation. From whom?
I understand what you're saying but why is it so difficult to determine if a crime has been committed. Why can't they just be deported. And seriously... how many of them do you think are real terrorists? Not saying that NONE are, but is it just an assumption?
What a friggin mess.
Of Course It's Controversial
by Kaveh Nouraee on Mon Nov 10, 2008 03:19 PM PSTAnd it's not because it's not "Bush's way". Bringing them to U.S. soil raises the very real possibility of retaliation on U.S. soil, for one. Releasing them? Do you think they're just going to say, "OK, thanks for the hospitality. Next time you catch me, can I stay at the Holiday Inn Express outside of Little Rock, Arkansas?"
They're being held as enemy combatants, not criminals. Whether you want to believe it or not, or whether you like it or not, there are still a couple of wars going on. They weren't picked up at the mall for shoplifting.
There's no real easy way to resolve this. This has been completely unconventional. There's never been an attack on U.S. soil like 9/11, so there's no precedent.
This is just plain criminal.
by American Wife on Mon Nov 10, 2008 03:03 PM PSTThe sooner Obama makes some progress... ANY progress towards resolving this, the better. Cleared of wrong doing but still detained? Can't find a country to take them? Why does any country have a choice. If it's a Saudi citizen, send him back. If he's Iraqi, why does Irag get to decide if they want him back. Why shouldn't they be tried on American soil? As ID says, if they've been accused of criminal acts, they get a criminal trial. What a seri ass cluster this has been. Thanks GW...
