... since his problem began in the womb, Blue Cross considered the defect a pre-existing condition, even though it would have been impossible for his parents to have known about it until he drew his first breath.  Houston’s mother had no complications during her pregnancy that would have warranted any kind of diagnostic procedure that could have detected it.

I'm sure the Republicans and the insurance companies will pull all sorts of dirty tricks but I am still happy that the train has left the station. 

As for the pre-existing clause, my understanding is that even now it is limited to any condition that was previously diagnosed, or was known to or should have been known to exist. I may be wrong but that's what I've always thought it to be. And in fact I remember being told at some point that they could claim the 'should have known' excuse only for a given period after commencement of the policy not for ever.

In some cases the illness may not appear until a decade or two into a person's life span. I wonder if the insurance companies are so desperate that they would deny converage to someone in the case that I described?

There's some time until Sept. when Republicans will repeal and Dems will still sell it.  Also new definitions of pre-existing may pop out of majorly funded institutions...., stay tuned. When it comes to healthcare Corporations you can call me paranoid.

Per the new bill as of Sept 2010 the pre-existing bs is out of the window. Unfortunately that doesn't help this poor family who lost their baby already or anyone between now and then. This particular case should really go to trial I think. This is shameless to set legal precedent if nothing else.  Some SOB, an individual made this decision knowing the child would die.I wonder how these people sleep at night.
