As for the pre-existing clause, my understanding is that even now it is limited to any condition that was previously diagnosed, or was known to or should have been known to exist. I may be wrong but that's what I've always thought it to be. And in fact I remember being told at some point that they could claim the 'should have known' excuse only for a given period after commencement of the policy not for ever.

In some cases the illness may not appear until a decade or two into a person's life span. I wonder if the insurance companies are so desperate that they would deny converage to someone in the case that I described?

Unfortunately that doesn't help this poor family who lost their baby already or anyone between now and then. This particular case should really go to trial I think. This is shameless to set legal precedent if nothing else. Some SOB, an individual made this decision knowing the child would die.I wonder how these people sleep at night.
