Regular readers of the LB and other legal publications might find themselves surprised to learn that the Federal Trade Commission on Monday sued POM Wonderful LLC, the maker of that pomegranate drink in the strangely shaped bottle.
The surprise comes not from the fact that the FTC sued POM at all, but that it’s only happened now. News associated with FTC’s investigation into POM has been going on for weeks. Plus, as a peremptory move, Pom had already sued the FTC.
In any event, full steam ahead. The FTC’s suit alleges that POM’s advertisements for POM Wonderful 100% Pomegranate Juice and its POMx supplements contain “false and unsubstantiated claims” about treating or preventing heart disease, prostate cancer and erectile dysfunction.
