"Lawyer of the Year" in Massachusetts

Massachusettes Lawyers Weekly: Newton officials should have expected trouble in 2006 when they decided to use nearly $1million in Community Preservation Act funds to upgrade two parks in the Nonantum section of the city. They may have been doing something nice for local residents. And the money was just sitting there,obviating the need to push for funds as “capital improvements” in an always-unpopular Proposition 2 1/2 override.But they also knew Guive Mirfendereski was out there.

Mirfendereski, an energetic Iranian-born lawyer and activist who operates a solo practice out of his Newton home when he’s not busy writing about international law or making furniture from discarded lobster traps, had already helped sink the city’s plan earlier that year to use CPA money to build artificial-turf athletic fields at Newton South High School. Though his lawsuit alleging that the turf constituted an impermissible use of CPA funds was dismissed as premature, the city ultimately backed down.

And when officials passed their Nonantum plan, Mirfendereski was waiting. Representing 10 taxpayers on a pro bono basis, Mirfendereski convinced a Superior Court judge that the CPA—which is meant to provide money for historic preservation as well as the expansion of recreational land and community housing—prohibited the park upgrades because the land in question hadn’t been acquired with CPA money.The Supreme Judicial Court affirmed in a decision that, according to Mirfendereski, “dramatically alters the course of business” for municipalities seeking to use CPA money for capital improvements.

Now, he says,towns will notbe able to use the CPA as an“end run”around Proposition21/2, as long as there are 10 taxpayers willing to bring a case. And while he admits regret that a legal technicality deprived neighbors of a worthy project, the rule of law trumps. “With a fading degree of accountability, we’d end up in a society no longer ruled by the intent of the Legislature,” he says. “This would not be a better society as a result.”>>> Full text PDF

Best Lawyer: Guive Mirfendereski

Congratulations to Dr. Mirfenderski for his accomplishments. I am actually not surprised to see him shines. He grew up in a very distinguished family, his father was of the Iranian Ambassador to the Soviet Union in the 70’s and he served our homeland in the most honorable way and one of the few Iranian Diplomat who could speak Russian fluently; it is natural that such a father should have such a son.

Guive, not only shines in Massachusetts but he is one of the top authority in the international affair, graduated from Fletcher School of Law and Diplomacy (Tufts University); one of the most prestigious institution in the country and has written lots of articles in various Journals.

I, as everyone else in this forum, am very proud of Dr. Mirfenderski and wish him the best of luck!

Mir Fendreski on the award well deserved.   I knew you were a special Iranian when I first read your article "Power of One" right here on Iranian.com.   All we have to do now is to figure out a way to join forces and become more than one - not only for the sake of Iran but for the sake of millions of us outside Iran.

Creative Lawyer and a more than creative philologist!!

I congratulate Dr Mirfendereski on being counted among the lawyers of the year 2008 in the commonwealth of Massachusettes. I strongly urge him to continue to be creative within the framework of his law practice as there is a huge scope there for his creative mind to work. But I strongly advise him to stay clear of being creative in a field for which he has possesses no training but evidently huge interest: philology. His creativity there will, as it already has, lead to misinformation for the readers and ridicule by the erudite!
