The US 7th Circuit Court of Appeals sides with OBF & BUPC against Wilmette Haifan Bahais

The United States 7th Circuit Court of Appeals affirms the earlier Illinois Court's (i.e. Judge St. Eve's) opinion on the Wilmette based US Baha'i NSA's (National Spiritual Assembly's) contempt action brought against the Orthodox Bahai faith and Bahais Under the Provisions of the Covenant. The larger Haifan Baha'i organization today officially lost its appeal with the appelate court with the court unanimously finding the arguments put forth by the Haifan US NSA to be completely spurious. Attorney Jeffrey Goldberg has announced on the USENET group talk.religion.bahai that a PDF of the decision will be going up on his site shortly.

The Court of Appeals of the Seventh Circuit denied the
Wilmette NSA's petition for rehearing. The NSA has 90 days to file a
petition for certiorari with the U.S. Supreme Court or the decision
will then become final.

Unless you people try to lean on these Circuit Court Judges with physical intimidation or some other untoward way, there is no way they will reverse their own decision. They aren't going to even approve your cult's application for a re-hearing. All this has done now is proven you people are SORE LOSERS and so deserve to be legally smacked around even more.

Times change bad decisions

The current legal climate has more relevent judicial review, case law and Supreme Court decisions behind it than the stupid decision of the 1960s that went unchallenged because Remey didn't have the money to challenge it - and which could've faced the same fate had it been challenged like in this one. But as in the Sohrab case, which you people also lost, the appelate court has found no convincing argument or precedent to allow you people the monopolization of the name "Bahai" and to trademark it as if it was a product. As such the appelate court does not believe or uphold your cult's insistence on such nonsensical arguments as "illegal use of the name Baha'i."

Implicitly this appelate court decision of the US 7th Circuit also concedes that there are multiple Bahai sects in existence and that the Haifan Bahai organization is only one of them and not the sole proprietor of this name. Given this, there is no legal basis anymore for the claim "illegal use of the name Bahai." Period. If you believe otherwise, try to see if the USSC clerk will even take your case after losing it twice in a row now, first in the original court and now in appeals. It appears that you have been trounced by the "covenant breakers."

Thankfully there is some justice in this universe and today an American appeals court handed it out and made you people look like the complete idiots that you are. Now go circle your wagons...

This points to nothing but the current legal climate; as the previous and original judgment ruled against the illlegal use of the Name Bahai.

Further, Mason Remey himself forbad his followers from further appeal at that time before his death.
