به گزارش خبرنگار ما علي مهين ترابي که متهم است در 16سالگي همکلاسي خود به نام مزدک را با ضربه چاقو به قتل رسانده از سال 81 در زندان به سر مي برد.
علي 14 بهمن ماه سال 81 بلافاصله پس از مرگ مزدک توسط پليس دستگير شد و در اعترافاتش گفت؛ من مسوول انتظامات مدرسه بودم و به اتفاق يکي از دوستانم به نام عزت با هم حفظ نظم حياط مدرسه را برعهده داشتيم. مزدک چند بار دير به مدرسه آمده بود و بر سر اين موضوع با عزت درگيري داشت. روز حادثه هم عزت دوباره با مزدک به خاطر دير آمدنش مشاجره کرد، من جلو رفتم که ببينم چه شده، مزدک فکر کرد قصد دارم از عزت هواداري کنم، وقتي درگيري تمام شد مزدک مرا به دعوا پس از زنگ آخر تهديد کرد. وي ادامه داد؛ زنگ آخر که به صدا درآمد، بچه ها براي خروج جلوي در رفتند. عزت به من چاقويي داد و گفت اين چاقو را در جيبت بگذار چون احتمالاً مزدک به من حمله مي کند و نمي خواهم با او درگير شوم. همين اتفاق هم افتاد. وقتي من و عزت به سمت در خروجي رفتيم مزدک و دوستانش جلوي ما را گرفتند و درگيري شروع شد. ازدحام بچه ها زياد بود، من نمي خواستم به کسي آسيبي برسانم به همين خاطر هم عقب عقب رفتم، مزدک به من حمله کرد و من براي اينکه او را بترسانم خيلي سريع چاقو را از جيبم بيرون آوردم و باز از وي فاصله گرفتم. اما موج جمعيت مزدک را به سمت من هل داد و مزدک روي من پرت شد و هر دو روي زمين افتاديم و چاقو در بدنش فرو رفت در حالي که من هيچ قصدي نداشتم که او را بکشم.
اعترافات علي مورد قبول ماموران و دادگاه قرار نگرفت و شعبه 33 دادگاه عمومي کرج علي را به قصاص محکوم کرد. هرچند مادر مزدک در همان روزهاي اول اعلام گذشت کرد، اما با اصرار پدر مقتول علي که 16 سال داشت به قصاص محکوم شد. با اعتراض متهم، پرونده به ديوان عالي کشور فرستاده شد و حکم صادره در ديوان نيز مورد تاييد قرار گرفت و اين بار پرونده براي استيذان به دفتر رئيس قوه قضائيه ارجاع شد. زماني که پرونده نزد رئيس قوه قضائيه بود، محمد مصطفايي وکيل مدافع علي با ارسال لايحه يي به دفتر آيت الله هاشمي شاهرودي ايرادات پرونده را متذکر شد. در اين لايحه آمده بود؛ پزشکي قانوني اعلام کرده جراحت 8 سانتيمتر پايين تر از سينه مقتول و عمق آن تقريباً 2 سانتيمتر بوده و به صورت مستقيم نيز وارد نشده است. اين نظريه ادعاي علي را مبني بر اينکه موج دانش آموزان مزدک را به روي او انداخته، تاييد مي کند. همچنين تحقيق از شاهدان درست نبوده چرا که ناظم وقت مدرسه که شاهد ماجرا بوده ادعاي علي را تاييد کرده و گفته است؛ «همه بچه ها يکدفعه روي زمين افتادند و وقتي بلند شدند مزدک چاقو خورده بود.»
متاسفانه شاهداني که دادگاه به گفته هاي آنها استناد کرده خود از متهمان پرونده بوده اند که مطابق قانون نمي توان به گفته هاي اين شاهدان استناد کرد.
رئيس قوه قضائيه پس از بررسي دقيق پرونده، ايرادات وارده را پذيرفت و حکم قصاص علي مهين ترابي را نقض و دستور ارسال پرونده را به دادگستري استان تهران صادر کرد.
هم اکنون پرونده علي که يک بار ديگر فرصت اثبات بي گناهي به او داده شده به دادگستري کل استان تهران ارسال شده تا پس از طي مراحل قانوني، شعبه هم عرض رسيدگي دوباره به آن را آغاز کند.
آيت الله هاشمي شاهرودي روز دوشنبه حکم قصاص دو نوجوان ديگر به نام هاي محمد فدايي و بهنود شجاعي را نيز که به جرم قتل در آستانه قصاص قرار داشتند، متوقف کرده بود.

Azarin Sadegh: So what if he has been nice to other inmates? Everybody is supposed to be nice. Getting into fights and pulling out a knife is what got him into this mess in the first place. Only if he were nice when he killed that boy. I haven't pulled out a knife in my entire life. He did so, and now he's paying for his stupidity. (All this said, I'm against capital punishment in this case, given the evidence and his age.)

By the judiciary laws of I.R.I., the time he has been in jail must be considered double. More than 13 years, because he is imprisoned without a sentence. It's doing time as "belaa taklif" wich has lots of pressure mentally cuz he's doing time in a state of doubt.
Well, praise the lord that the young man is still alive and hopefully he will be free very soon.
PS I just don't believe his side of the story (pulling a knife and walking away!), but he was only a teenager at the time. Anyway, I'm very happy for him and HIS FAMILLY that he's not execu...

They said that there's a good chance for him to be freed soon because he has been in prison for almost 7 years and it's even two years more than the normal time for manslaughter in Iran.
So let's hope together!
But actually what really touched me the most was something else they said about Ali: Ali seems to put all his drive into helping other kids on death row...since then he hasn't been very much worried about himself.
Isn't it like the simple recipe for happiness?
I know it’s not going to be easy. The freedom for a half dead man could mean nothing. But I can easily imagine Ali, a free Ali, who is going to study law and to become like another Mostafai (the determined lawyer who has made it all happen). Because Ali’s the only one who really knows what it means to wander in that dark zone between death and life.
I wish him the best. I welcome him back into life!
