Received alien number

Hello Mr. Taheripour,

Hoping that you are well. I have read the section of "Legal Ali" in Iranian.com and was wondering if you would answer my question as well. I have received my U.S. Alien Number and I am waiting for my Green Card through mail. Since my Green Card has not been finalized yet, if I marry a man in Iran, can I still bring him with a visa? I understand that when I receive my Green Card it will take years, but how about now? Is it true that while in the process, if I get married I can also bring my spouse?

Dear Anonymous,

Receiving an alien number does not necessarily mean that you have succeeded in obtaining lawful permanent resident status or that your Green Card is going to be sent to you through the mail.

An alien number or “A number” can be assigned to many people at the initial stage, when they are just applying for immigration benefits. The A number is primarily for purposes of tracking the person’s file. The actual benefit sought could be obtained years after the A number has been assigned to that file and in some cases the benefit may ultimately be denied.

You should consult with an attorney to determine just exactly what your case status is right now and by the same token, find out if you get married right now, whether your intended spouse qualifies for follow to join benefits.

The general rule is that your spouse may be eligible to receive following to join benefits if he was married to you before you became a permanent resident. Hence the necessity of having a legal professional look at your papers to determine your true current status in the United States.

Is birth certificate enough at the border?

We are planning to visit my family in Toronto this week. My son and daughter were born in the U.S. but we never applied for a passport for them. I was wondering if their birth certificates are acceptable documents on our return in lieu of their passports. Thank you for taking the time to respond to my question in advance.

Currently, the advisals on the U.S. Customs and Border Protection official website state that “Due to heightened security it is strongly recommended that U.S. citizens present their passports even when returning from travel only to Canada or Mexico.”

Getting a passport from the Department of State is not too difficult nor time-consuming (expedited service can be requested for an additional fee). Information about procedures can be found at the U.S. Department of State website by clicking here.
