آنچه در پی میآید ششمین پیشنویس قانون اساسی دولت سکولار انتقالی است. تصور این نیست که این متن بیاشکال یا نهایی باشد اما تلاشی آغازین به سمت چارچوبی تعریفشده برای آیندهای آزاد و دموکراتیک در ایران است و این متن میتواند قانون اساسی انتقالی پس از سقوط جمهوری اسلامی و پلی از 31 سال دیکتاتوری مذهبسالار به دموکراسی سکولار باشد. پس از کسب محیطی دموکراتیک که نماینده مردم باشد، هر گونه خطای احتمالی در متن این قانون مورد بحث باز و آزاد توسط مردم و نمایندگان واقعیشان قرار میگیرد تا زمانی که قانون اساسی نهایی تدوین شود.
از تاریخ پخش پیش نویس قبلی در ۲۲ بهمن تا به حال پیشنهادات مختلفی از طریق ایمیل، تارنما و بلاگ ایران سکولار و سایت ایرانیان شده است که این پیش نویس نو منعکس کننده این پیشنهادات میباشد.
در ضمن همان گونه که در مقاله "راه رسیدن به آزادی " درج شد ، در راه هدف یگانگی و همبستگی همه مردم و نیروهای سکولار، در پیش نویس جدید تا حد امکان تلاش شده که برتری به شیوه حکومتی به خصوصی داده نشده و این تصمیم را به آینده واگذار کنیم. تنها پس از همبستگی برای سقوط رژیم دیکتاتور نظامی مذهبی کنونی و ایجاد یک نظام سکولار دموکراتیک، انتخاب شیوه حکومتی به پیشنهاد نمایندگان راستین مردم و پس از تصمیم گیری مردمی در سایه امنیت قانون اساسی موقت و ایجاد فضای آزاد، سکولار و دموکرات انجام پذیر خواهد بود.
در این راه سه قوای مستقل سکولار : مجریه با ریاست انتخابی "رییس دولت "، مقننه توسط مجلس شورای ملی و قضاییه امور کشور را بر عهده خواهند داشت. تمام احزاب، گروهها، شخصیت ها در سایه این نظام آزاد قادر به تبلیغات و شرکت در انتخابات برای ریاست دولت و نمایندگی مجلس شورای ملی و یا مجلس موسسان خواهند بود که در صورت کسب اکثریت میتوانند خواستار تغییر قانون اساسی شوند که در صورت تصویب مجلس شورای ملی و موسسان در انتها به آرای مردم گذشته خواهد شد.
امید است که خوانندگان همانند ۱.۵ سال گذشته در تصحیح و تکمیل این متن یاری و سپس با هر باور سکولار و دموکرات که باشند در راه ایجاد، سازماندهی و تبلیغ "جبهه همبستگی ایرانیان " اقدام نمایند. گسستگی در ۳۱ سال گذشته از آمال رژیم کنونی بوده و همبستگی در محور اهداف سکولار و دموکراتیک مشترک تنها راه سقوط رژیم و ایجاد ایرانی آزاد و سکولار میباشد که یک دست صدا ندارد .

You almost got me convinced to include "The right to own shoes" in the constitution. That would have a lot of meaning and very innovative comparing to all other constitutions!

MM: The issue of local language has been left to the local decisions. I believe the issue that you are mentioning will fall in the other individual rights? I am open to further discussion on the subject but I basically agree with your thought.
I believe issue of flag is different than calender. Emblem is something that can be discussed in future. As for teh start of the calender, a secular start is what I have thought of and in our history the year of introduction of human rights as a secular date can be a meaningful one. I am not aware of any internationally and nationally recognized non-religious event in our history with such impact across all nations and religions.
The issue of women's right vs monogomy or polygomy I believe are different. I believe people have the right to different family arrangements and it is not up to the government to force it upon them AS LONG AS THE RIGHTS OF EVERYONE IN THE FAMILY , WOMEN AND THE CHILDREN ARE PROTECTED. This is not a religious or government matter in my view, but an individual and human rights issue. REGARDLESS, Such issue I believe should be addressed within the country's laws and not constitution as constitution sets a guideline for the rights and then the laws are derived based on those.
Captain: Thank you for kind words. As for the right to bear (registered) arms I personally am against it but at the same time I understand that will be a touchy subject subject to future discussions for the final constitution and therefore in the INTERIM I have left the issue untouched. Just as I have not addressed Federalism during the interim.
Other very important rights that you had addressed are all in the very beginning of the document: preamble, summary as well as article 1.
Right to bear arm

Secondly, Freedom of speech, expression, religion and peaceful demonstrations should be one of the first lines and it should be inalienable rights.

Chap 2, 3, 4: I am glad that you put in comments on having a healthy agriculture/industry since in the absence of oil revenues, the government will need a stong tax basis from industry/agriculture/people to be able to support the entitlements given to the people. It should be understood that taxes will eventually need to supplement oil revenues.
Chap 2: local languages should be encouraged (as well as a foreign language), but the local languages/dialects should not be forced on everyone. For example, if an Arab family is moving to Azerbaijan because of a government job, the children should not be forced to learn Azeri.
Chap 2: I am neutral on calendar, 1 or 2 day weekend or the type of flag to be decided later in a referendum. Besides, if moving the calendar to King Cyrus times, it makes sense to adapt the Cyrus flag as well (//faryadpars.blogfa.com/post-71.aspx).
Chap 3: I noticed that nothing is said about monogamy vs. polygamy and where sigheh stands here. Or, is that understood since the sexes are equal?
